Federal Judge Mandates Release of Kilmar Abrego Garcia from ICE Custody

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks legal authority.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.

The situation originates in a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an mistake. Following his return to the United States to answer human smuggling charges, he was detained in federal custody.

In her order, the judge noted that the authorities lacks a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."

Background of the Case

The legal challenge involve conflicting claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.

He has also entered a not guilty plea to the conspiracy charges, which are part of a separate criminal case in Tennessee.

The judge, who was overseeing his petition to deportation in a federal court, determined that he must now comply with the conditions of his release from custody in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.
